Chapter I: The provision makes the requirements of Council Directive 98/18/EC on safety rules and standards for passenger ships applicable to passenger ships built using materials other than steel or equivalent materials.
Chapter IV: Requirements stipulating that existing passenger ships less than 24 metres in length shall have GMDSS equipment by 1 February 2003 at the latest.
Chapter VI: The amendment shall ensure that on passenger ships in national service there are fixed procedures for the securing of cargo and cargo units.


9. Brief Statement of Grounds
Chapter I:
Council Directive 98/18/EC on safety rules and standards for passenger ships exempts passenger ships built using materials other than steel.
Before the Directive entered into force, the national requirements for passenger ships in Danish national service applied, irrespective of the material with which they were constructed. In practice, this prohibited the construction of passenger ships using flammable materials. These national requirements still apply to passenger ships built using materials other than steel. The purpose of the provision is to clarify that it is still prohibited to build passenger ships for Danish national service using flammable materials.
Chapter IV: Ever since all new passenger ships, irrespective of length, and existing ships of 24 metres or more in length converted to GMDSS with the Passenger Ship Directive of 1 February 1999, the plan has been that the all other passenger ships would convert to GMDSS in 2003, so that all ships are covered by the same emergency, distress and safety system.
Chapter VI: The amendment shall ensure that on passenger ships in national service there are fixed procedures for the securing of cargo and cargo units. In the meantime it has been decided that requirements regarding an approved manual on the securing of cargo would result in a disproportionate financial burden for passenger ships in national service when the requirement is related to the protected waters which most of these passenger ships navigate. Passenger ships in national service already use an approved safety management system (the ISM Code), which, depending on the crossing and the nature of the waters, contains procedures for securing cargo units and other goods. Even though the ISM is approved by the Administration, the individual procedures and instructions will only rarely be examined and approved as independent elements. Nevertheless, they must be taken as a manifestation of how the shipping company/ship, on the basis of a thorough knowledge of the ship and the local conditions, will make sure that cargo and cargo units are not displaced during transportation at sea. In the case of passenger ships which only navigate routes in protected waters (areas B, C and D), it is therefore sufficient for these procedures and instructions to be included in the ship's safety management system. In the same way as ships in international service, passenger ships which navigate open waters (area A) must have an approved manual on the securing of cargo.
